Terms of Service
These terms are an agreement between you and DropCircle ("we", "us") for using dropcircle.net and its apps (the "Service"). By using the Service, with or without an account, you agree to them. If you don't agree, please don't use DropCircle.
1. What DropCircle does
DropCircle lets you:
- send files directly to nearby devices (peer to peer, not stored by us);
- upload files and share them with a link, in albums or in rooms;
- post messages and files in rooms that other people join with a code or QR.
We may change, add or remove features over time. If a change takes away something you paid for, we'll offer a fair remedy under our Refund Policy.
2. Who can use it
You must be at least 13 years old, or the minimum age for online services in your country if that's higher. If you use DropCircle for an organisation, you confirm you're allowed to accept these terms for it.
3. Accounts and guest access
- You can use many features without signing up. We then create a guest account tied to your browser. Clearing browser data can lose access to it.
- Keep your password safe and don't share your account. You're responsible for activity on it.
- Tell us right away at support@dropcircle.net if you think someone else has access to your account.
4. Your content
You keep all rights to the files, messages and other content you upload or post ("your content"). You give us a limited permission to store, process (for example to make previews and video versions), and show or send your content, only to run the Service for you and the people you share with.
Anyone with a link, room code or QR you share can open that content, and they can download and keep copies unless you've turned on view-only or download limits. Share carefully.
You confirm you have the right to upload and share your content, and that it doesn't break these terms or anyone else's rights.
5. What you must not do
Don't use DropCircle to upload, share or link to:
- child sexual abuse material. We report it to the authorities and keep what the law requires;
- content that infringes copyright or other rights, or that you don't have permission to share;
- malware, phishing pages or anything meant to harm devices or steal data;
- content that threatens, harasses or exposes someone's private information without consent, or that promotes violence or terrorism;
- anything illegal where you or the recipient live.
Also don't:
- try to break, overload, probe or get around the security or limits of the Service;
- access accounts, rooms or files that aren't shared with you;
- resell the Service, or use it to run a file-hosting or CDN service for others, without our written permission.
6. Rooms
The person who creates a room is its host. Hosts decide who can join, who can post, and when people are removed (for example automatically after 30 days), and can remove or block anyone. Hosts and authors can edit or delete posts. We aren't responsible for how a host runs a room. If you see abuse, report it to us.
7. Plans, payments and limits
- Free and paid plans have the storage, file size, retention, room and member limits shown on the Plans page at the time you buy.
- Prices are in US dollars. Taxes and network or exchange fees may be added by the payment provider.
- Crypto payments through Plisio buy a fixed period (30 days or 1 year) and don't renew on their own. If card payments through Paddle are offered, they renew until you cancel. You can cancel any time in Account, and you keep access until the end of the period.
- When a paid period ends, your account moves to Free. Files kept longer than Free allows get a fresh Free retention period before they're deleted, not instant removal.
- Refunds follow our Refund Policy.
8. File expiry and deletion
Files are deleted automatically when they expire, based on your plan or the expiry you chose. Deleted files can't be recovered. DropCircle isn't a backup service: keep your own copies of anything important.
9. Copyright complaints
If you believe content on DropCircle infringes your copyright, email support@dropcircle.net with the link, what work it infringes, your contact details, and a statement that your complaint is accurate and that you're the owner or authorised to act for them. We remove infringing content and close the accounts of repeat infringers.
10. Suspension and termination
We may remove content, or suspend or close accounts, that break these terms or put users or the Service at risk. Where reasonable, we'll tell you why. You can stop using DropCircle and delete your account at any time from Account. Deleting your account removes your files.
11. Disclaimers
We work hard to keep DropCircle fast, safe and available, but the Service is provided "as is" and "as available". To the extent the law allows, we make no promises that it will be uninterrupted, error-free, or that files will never be lost.
12. Limitation of liability
To the extent the law allows, we aren't liable for indirect or consequential losses, lost data or lost profits. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim, or US$20. Nothing here limits liability that can't be limited by law, or your rights as a consumer.
13. Changes to these terms
We may update these terms. For important changes, we'll show a notice on the site or email account holders before they take effect. If you keep using DropCircle after that, you accept the new terms.
